These Terms and Conditions ("Terms") govern your use of our website and the services we offer, including book publishing, book formatting, illustrations, marketing, book cover design, web design, logo design, web and mobile app development, and creative writing.
By accessing our website, placing an order, or using any of our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.
1. About Us
Authors Pan Digital is a full-service digital agency based in the United States.
2. Eligibility
To use our services, you must be at least 18 years old and legally able to enter into a binding contract under United States law. By placing an order, you confirm that you meet these requirements and that all the information you provide is accurate and complete.

Each service has its own scope, deliverables, timeline, and pricing, which will be agreed upon in writing before work begins. Any work outside the agreed scope may result in additional charges.
4. Orders and Quotes
All quotes and proposals are valid for [30] days from the date of issue unless otherwise stated. A project officially starts once you accept the quote, agree to these Terms, and pay the required deposit or full amount as outlined in the proposal.
We reserve the right to refuse, cancel, or decline any order at our discretion, including in cases of suspected fraud, unlawful activity, or content that violates our policies.
5. Pricing and Payment
All prices on our website and in our proposals are listed in United States Dollars (USD) unless otherwise stated. Pricing may change at any time, but changes will not affect orders that have already been confirmed.
Payment terms:

For one-time projects, a deposit of [50%] is required before work begins, with the balance due upon completion and before final files are released.

For monthly packages, payment is billed in advance on a recurring basis.

6. Refunds and Cancellations

Before work begins: You may cancel and receive a full refund of any deposit paid, minus any non-refundable third-party fees (such as ISBN registration, domain purchases, or stock licenses).

After work begins: Refunds will be based on the percentage of work completed. Work already delivered or hours already logged are non-refundable.

After final delivery: All sales are final once final files have been delivered and accepted.

Monthly subscriptions: You can cancel at any time. Cancellations take effect at the end of the current billing cycle, and we do not issue partial refunds for unused days.

7. Revisions
The number of revisions included is listed in each service package. Additional revisions beyond the included amount will be billed at our standard hourly rate or as agreed in writing. Revision requests must be submitted within [14] days of receiving the draft, otherwise the work is considered approved.
8. Client Responsibilities
To deliver your project on time and at the quality you expect, we need your cooperation. You agree to:

Provide accurate, complete information and source materials on time

Respond to questions, drafts, and approval requests within a reasonable timeframe

Confirm that all content you provide (text, images, logos, names, brand assets) is legally yours to use, or that you have permission to use it

Make payments on time as agreed
Delays caused by missing information, late approvals, or unpaid invoices will push back the project timeline, and we are not responsible for those delays.
9. Intellectual Property
Your content: Anything you provide to us (manuscripts, brand assets, photos, written material) remains your property. You give us permission to use it only for the purpose of completing your project.
Our work: Until full payment is received, all designs, drafts, code, illustrations, and other deliverables remain the property of Authors Pan Digital. Once payment is complete, ownership of the final deliverables transfers to you, except for:

Third-party assets (fonts, stock images, plugins, software licenses), which remain governed by their original licenses

Pre-existing tools, frameworks, or code libraries we use across multiple projects, which remain our property

Concepts, drafts, and versions that were not selected as part of the final delivery
Our portfolio rights: Unless agreed otherwise in writing, we reserve the right to display completed work in our portfolio, case studies, social media, and marketing materials for promotional purposes.
10. Confidentiality
We treat your project details, business information, and any sensitive material you share as confidential. We will not share your information with third parties except as needed to complete your project (for example, with printers, hosting providers, or freelance contractors who are bound by their own confidentiality terms).
If your project requires a formal Non-Disclosure Agreement, we are happy to sign one before work begins.
11. Third-Party Services
Some of our services rely on third-party platforms such as Google Play Store, WordPress, Shopify, Stripe, PayPal, hosting providers, and others. We do not control these platforms and are not responsible for their fees, policies, downtime, rejections, or changes to their terms of service.
You agree to comply with the terms of any third-party platform used as part of your project.
12. Acceptable Use
You agree not to use our website or services to:

Violate any United States federal, state, or local law

Infringe on the intellectual property, privacy, or rights of any other person or business

Create or distribute content that is illegal, harmful, hateful, defamatory, fraudulent, obscene, or that promotes violence or discrimination

Transmit viruses, malware, or any code intended to damage or interfere with systems

Attempt to gain unauthorized access to our website, accounts, or any related systems

Use our services for spam, phishing, or any deceptive practices
We reserve the right to refuse service, terminate accounts, or cancel projects that violate these terms, without refund.
13. Disclaimer of Warranties
Our services are provided on an "as is" and "as available" basis. While we do our best work on every project, we do not guarantee:

Specific sales, rankings, traffic, or commercial results from any book, website, app, or marketing campaign

That third-party platforms will approve, accept, or rank your project

That our website or services will be uninterrupted, secure, or free of errors
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Limitation of Liability
To the fullest extent permitted by United States law, Authors Pan Digital, its owners, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost data, or business interruption, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from or related to our services will not exceed the amount you paid to us for that specific project or service in the [6] months preceding the claim.
15. Indemnification
You agree to defend, indemnify, and hold harmless Authors Pan Digital and its team from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:

We reserve the right to terminate or suspend your access to our website or services at any time, without notice, if you violate these Terms or engage in conduct we believe is harmful to our business, our team, or other clients.
Upon termination, any unpaid invoices remain due, and any work completed up to the point of termination remains billable.

Any dispute arising from or related to these Terms or our services will first be addressed through good-faith negotiation.
